Client Terms And Conditions
1. Definitions
For the purposes of these Terms and Conditions, the following definitions apply:
"Client" means any individual or organisation purchasing or receiving the Services.
"Services" means any professional services provided by Miia Viita (legal name: Miia Viitanen), including but not limited to consultations, mentoring, coaching, executive mentoring, RTT® (Rapid Transformational Therapy®), hypnotherapy, intuitive guidance, energy work, channeling, workshops, group programs, individual sessions, online courses, digital resources and any related professional services.
"Agreement" means the agreement between the Client and Miia Viita, incorporating these Client Terms and Conditions, the Privacy Statement, and any written proposal, booking confirmation, invoice, programme description or other written communication relating to the Services purchased.
2. Scope of Services
These Terms and Conditions apply to all Services provided by Miia Viita unless otherwise agreed in writing.
The specific content, duration, format, pricing and any inclusions of the Services will be described in the relevant booking confirmation, invoice, proposal, programme description, website page or other written communication provided to the Client before purchase.
The Services may be provided online or in person and may include individual sessions, group sessions, mentoring programmes, workshops or other professional services.
The Services are intended to support the Client's personal and/or professional development. They are not intended to diagnose, treat or cure any medical or psychological condition and do not replace appropriate medical, psychological, psychiatric, legal, financial or other professional advice.
Where the Services include RTT®, hypnotherapy or other therapeutic techniques, the Client acknowledges that these methods are intended to support personal development and wellbeing and are not a substitute for appropriate medical or mental health care.
3. Bookings
A booking becomes confirmed once it has been accepted by Miia Viita and any required payment has been received.
By booking, purchasing or otherwise receiving any Services, the Client confirms that they have read and accepted these Client Terms and Conditions and acknowledge the Privacy Statement.
The Client is responsible for ensuring that all information provided during the booking process and throughout the provision of the Services is accurate and complete. The Client agrees to inform Miia Viita of any material changes that may affect the delivery of the Services.
Miia Viita reserves the right to decline or discontinue Services where it is considered that the Services are not appropriate for the Client or where continuing the professional relationship would no longer be appropriate.
4. Age Requirements
Unless otherwise agreed in writing, the Services are intended for individuals aged 18 years or older.
5. Fees and Payment
All fees will be communicated to the Client before the booking is confirmed.
Unless otherwise agreed in writing, payment for online Services must be made in full before the first scheduled session or the commencement of the relevant programme or service.
For in-person Services, payment must be made either in advance or at the time of the appointment, as agreed when booking.
Where a payment plan or instalment arrangement has been agreed, the Client agrees to make each payment by its due date.
Failure to make payment by the agreed due date may result in suspension of access to the Services until payment has been received. Continued non-payment may result in cancellation of the remaining Services without refund of any amounts already paid and without releasing the Client from any remaining payment obligations, where permitted by law.
Professional fees may be reviewed from time to time. Any changes will not affect Services that have already been purchased unless otherwise agreed in writing.
6. Rescheduling, Cancellation and Missed Sessions
If the Client needs to cancel or reschedule an individual session, at least 24 hours' notice must be given. Requests received with less than 24 hours' notice may, at Miia Viita's discretion, be treated as a completed session and the session fee or allocated session will be forfeited.
If the Client fails to attend a scheduled individual session without prior notice, the session will be considered delivered and no refund or replacement session will be provided.
If Miia Viita needs to reschedule a session, an alternative appointment will be arranged as soon as reasonably possible.
Where a session is interrupted due to technical difficulties or circumstances beyond either party's reasonable control, Miia Viita may, at her discretion, continue or reschedule the remaining portion of the session where appropriate.
Any cancellation or rescheduling of workshops, group programmes or other Services will be communicated directly to the Client where applicable.
7. Programmes, Packages and Instalment Payments
Where the Client purchases a programme, package or other multi-session Service, the specific content, duration, delivery format and inclusions will be those described in the relevant proposal, booking confirmation, programme information or other written communication provided before purchase.
Once a programme, package or coaching process has commenced, the Client may choose to discontinue their participation at any time. However, unless otherwise required by applicable law or agreed in writing, no refunds will be provided for Services already purchased.
Where an instalment payment arrangement has been agreed, payments must be made by their respective due dates. Failure to do so may result in suspension or termination of access to the Services until payment has been received.
Miia Viita reserves the right to withdraw access to any programme, sessions, materials or related Services where payment obligations have not been met.
8. Online and In-Person Services
Services may be provided online, in person or through a combination of both.
For online Services, the Client is responsible for ensuring access to a suitable device, a stable internet connection and an environment that allows the session to take place without unnecessary interruption.
The Client is responsible for joining online sessions at the scheduled time using the instructions provided.
For in-person Services, the Client is responsible for arriving at the agreed location at the scheduled time.
Unless otherwise agreed in writing, any travel, accommodation or other expenses incurred by the Client in connection with in-person Services are the Client's sole responsibility.
9. Client Responsibilities
The Client agrees to participate in the Services honestly and respectfully.
The Client is responsible for providing accurate and complete information that may be relevant to the delivery of the Services and for informing Miia Viita of any significant changes that may affect their participation.
The Client acknowledges that meaningful progress depends on many factors, including their own commitment, participation, decisions and actions both during and between sessions.
Where the Services include RTT®, hypnotherapy or other therapeutic methods, the Client agrees to disclose any relevant medical or psychological conditions that may affect the safe and appropriate delivery of the Services.
Miia Viita reserves the right to suspend or terminate the provision of the Services where the Client behaves in a threatening, abusive, inappropriate or unlawful manner, or otherwise acts in a way that makes it unreasonable or unsafe for the professional relationship to continue.
10. Professional Disclaimer and No Guaranteed Results
The Services are provided for educational, informational, personal and professional development purposes.
The Client acknowledges and agrees that no representation, warranty or guarantee has been made regarding any particular outcome, result or timeframe. Individual experiences and results will vary depending on many factors, including the Client's own circumstances, commitment, decisions and actions.
The Client remains solely responsible for all decisions, actions and outcomes arising from or related to the Services, including, without limitation, personal, professional, business, financial, legal, medical and health-related decisions.
The Services do not constitute medical, psychological, psychiatric, legal, financial, investment or other regulated professional advice and are not intended to diagnose, treat, cure or prevent any medical or mental health condition.
Where the Services include RTT®, hypnotherapy, intuitive guidance, channeling, energy work or similar modalities, the Client understands that these Services are complementary in nature and are not a substitute for appropriate medical, psychological, psychiatric or other licensed professional care.
The Client is solely responsible for seeking independent professional advice where appropriate.
11. Confidentiality
Miia Viita will treat all information shared by the Client during the provision of the Services as confidential and will not disclose such information to any third party except:
where the Client has given prior consent;
where disclosure is required or permitted by applicable law;
where disclosure is necessary to protect the Client or another person from a serious risk of harm; or
where disclosure is reasonably necessary for the establishment, exercise or defence of legal claims.
Where appropriate, Miia Viita may discuss aspects of a Client's case with professional advisors, supervisors or other professional consultants where reasonably necessary for professional development or supervisory purposes. Where reasonably possible, identifying information will be removed or limited.
Nothing in this section prevents Miia Viita from complying with any legal, regulatory or professional obligation.
12. Session Recordings
Group sessions may be recorded for the benefit of participants. By participating in a recorded group session, the Client acknowledges and agrees that their name, voice, image and any information voluntarily shared during the session may appear in the recording.
Individual sessions may be recorded only with the knowledge of the Client. Any recordings provided to the Client are for the Client's personal use only and must not be copied, reproduced, distributed, shared, published, sold or otherwise made available to any third party without the prior written permission of Miia Viita.
Miia Viita reserves the right to determine whether any recording will be made available following a session.
13. Audio Recordings
From time to time, Miia Viita may provide the Client with audio recordings, including but not limited to hypnosis recordings, RTT® recordings, guided meditations, relaxation recordings, visualisations, energy recordings or other audio materials (collectively, the "Audio Recordings").
The Client agrees to listen to the Audio Recordings only in a safe and appropriate environment where they can give the recordings their full attention and are able to relax safely without creating a risk to themselves or others.
The Client must not listen to any Audio Recording while driving, riding a bicycle, operating machinery, undertaking any activity requiring concentration, or in any other situation where reduced awareness or relaxation could create a risk to themselves or others.
The Client is solely responsible for ensuring that the Audio Recordings are used safely and appropriately.
Unless otherwise expressly authorised in writing by Miia Viita, the Audio Recordings are provided solely for the Client's personal use and must not be copied, reproduced, distributed, shared, published, sold, licensed or otherwise made available to any third party.
14. Intellectual Property
All content and materials provided by Miia Viita in connection with the Services, including but not limited to recordings, worksheets, exercises, presentations, written materials, audio recordings, videos, guided meditations, hypnosis recordings, digital resources, programme content, frameworks, methodologies, tools, templates, concepts and any other materials or information provided during the Services (collectively, the "Materials"), remain the intellectual property of Miia Viita unless otherwise expressly stated in writing.
The Client is granted a limited, personal, non-exclusive, non-transferable and revocable licence to use the Materials solely for their own personal or internal business use in connection with the Services.
Unless expressly authorised in writing by Miia Viita, the Client must not copy, reproduce, modify, adapt, translate, distribute, publish, transmit, display, sell, license, sublicense, assign, share, disclose, teach from, commercially exploit or otherwise make the Materials available to any third party, whether in whole or in part.
The Client must not use the Materials, or any part of them, to create, develop, market or deliver competing products, services, programmes or training, or to generate, develop, train, improve or otherwise support any artificial intelligence system, machine learning model or similar technology, or any content, product or service derived from such technology, without the prior written permission of Miia Viita.
Nothing in these Terms grants or transfers any ownership or intellectual property rights to the Client. All rights not expressly granted under these Terms are reserved by Miia Viita.
15. Limitation of Liability
The Client acknowledges and agrees that they participate in and use the Services entirely at their own discretion and assume full responsibility for all decisions, actions and outcomes arising from or related to the Services.
To the fullest extent permitted by applicable law, Miia Viita shall not be liable for any decisions, actions, omissions, losses, damages, costs, expenses or consequences arising directly or indirectly from the Client's participation in or use of the Services.
Miia Viita shall not be liable for any indirect, incidental, consequential, special or punitive damages, including but not limited to loss of profits, loss of revenue, loss of business opportunity, loss of data or reputational damage, whether arising in contract, tort (including negligence) or otherwise.
Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under applicable law.
Where liability cannot be excluded, Miia Viita's total liability arising out of or in connection with the Services shall, to the fullest extent permitted by applicable law, be limited to the amount paid by the Client for the specific Services giving rise to the claim.
16. Force Majeure
Miia Viita shall not be liable for any delay, interruption or failure to perform the Services where such delay, interruption or failure results from circumstances beyond her reasonable control.
Such circumstances include, but are not limited to, natural disasters, epidemics or pandemics, government action, war, civil unrest, strikes, power failures, internet or telecommunications outages, technical failures, illness, accidents or any other event beyond reasonable control.
Where reasonably practicable, the affected Services may be rescheduled or otherwise rearranged at Miia Viita's discretion.
17. Privacy and Personal Data
Personal information is collected, used, stored and processed in accordance with the Privacy Policy available on our website. By booking or purchasing the Services, the Client acknowledges that they have read and understood the Privacy Policy.
The Client is responsible for ensuring that any personal information they provide is accurate and up to date.
18. Changes to these Terms
Miia Viita reserves the right to amend or update these Client Terms and Conditions from time to time.
Any revised Terms will become effective upon publication on the website unless otherwise stated.
The version of the Client Terms and Conditions in force at the time the Client purchases or books the relevant Services will apply to that purchase unless otherwise agreed in writing or where changes are required by applicable law.
19. Governing Law and Dispute Resolution
These Client Terms and Conditions, together with any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law principles.
The parties agree to use reasonable efforts to resolve any dispute through amicable discussions before commencing legal proceedings.
Subject to any mandatory provisions of applicable law, the parties agree that the courts of Finland shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Client Terms and Conditions or the Services.
